Bovitz [and the Bovitz website] is owned and operated by Bovitz, Inc. (“Bovitz,” “we,” “us,” or “our”). This Privacy Policy is intended to inform clients, users of our website, research participants, panelists, and others of how we collect, use, share, and store personal information.
We strive to ensure that our privacy practices are compliant with applicable data protection and privacy laws, including, as applicable, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), and other state consumer privacy laws, as well as Washington’s My Health My Data Act and, where applicable, the European Union General Data Protection Regulation (“GDPR”).

By participating in research conducted by Bovitz, by using our website, or otherwise by supplying us with your personal information, you consent to the terms of this Privacy Policy, except to the extent applicable law provides you with specific rights that cannot be waived by consent.

Scope of This Privacy Policy
This Privacy Policy applies to personal information collected in connection with Bovitz’s market research activities, including quantitative and qualitative studies, recruiting, panel management, incentive administration, product testing, website operation, and related business activities. It applies to personal information collected from research participants, panelists, users of our website, clients, prospective participants, incentive recipients, and others who interact with us.
Depending on the context, Bovitz may act as a controller or business, or may act as a processor, service provider, or contractor on behalf of a client. When we originate or administer research ourselves, including through our own panel operations, we generally determine the purposes and means of processing personal information. When we conduct research on behalf of a client and pursuant to the client’s instructions, we may process personal information in a service-provider, contractor, or processor capacity.
Personal Information
“Personal information” means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, research participant, panelist, or household, as defined by applicable law.
Personal information may include, without limitation, real names, postal addresses, email addresses, telephone numbers, respondent IDs, unique identifiers, Internet Protocol addresses, digital fingerprinting or similar fraud-prevention data, geolocation data, audio or visual information, professional or demographic information, and inferences drawn from other personal information.
In connection with our research activities, we may collect personal information including real names, email addresses, telephone numbers, mailing addresses, ZIP codes, respondent IDs, age, sex, gender identity, sexual orientation, race or ethnicity, religious beliefs, parental status, marital status, education, professional credentials, survey responses, interview responses, focus group responses, political opinions, political party affiliation, and information related to consumer history, preferences, product testing, or study participation. Depending on the study, we may also collect audio or video recordings, and information relating to health, medical history, diagnoses, prescriptions, or health insurance.
We may also receive respondent IDs or other unique identifiers from clients, recruiting partners, or panel partners for research purposes. We may collect IP addresses and certain device, browser, timestamp, and related technical information automatically when you access one of our surveys, websites, or digital research tools.
Sensitive Personal Information
Please note that some of the personal information we collect, including without limitation information regarding your sexual orientation, racial or ethnic origin, religious beliefs, health-related information, political opinions, or similar data, may constitute “sensitive personal information” or “sensitive data” under applicable law.
We will not use your sensitive personal information except for research purposes, participant administration, identity verification, fraud prevention, legal compliance, and other purposes permitted by applicable law. Where required by law, we will provide any additional notice required and obtain any consent required before collecting or processing sensitive personal information.

Your Participation in Research
Participating in our market research studies is voluntary. We respect each respondent’s right to withdraw or to refuse to cooperate at any stage of a study and will not use any procedure or technique to coerce participation or imply that cooperation is obligatory.
Please note that financial incentives, honoraria, rewards, product-testing opportunities, sweepstakes entries, or similar benefits given to encourage respondents to participate may be provided by Bovitz or our agents, clients, or partners. Such incentives may be provided only if the applicable survey, interview, research project, or study is fully and properly completed by the respondent, in Bovitz’s discretion or in accordance with the applicable study rules.
Bovitz will inform participants at the outset if any interview or discussion is being audio or video recorded, in which case we will obtain all necessary consents. If any such recordings are to be used for marketing, promotional, testimonial, or other non-research purposes, we will obtain any separate consents, releases, or rights assignments required by law.
Information Collection and Usage
We may collect personal information for the purpose of conducting market research, recruiting and screening respondents, administering studies and panel participation, distributing incentives or honoraria, shipping products for in-home usage testing or similar projects, sending newsletters or marketing our services where permitted, maintaining research records, preventing fraud, complying with legal obligations, and as otherwise provided in this Privacy Policy.
Information we collect in connection with our research activities may include real names, email addresses, and phone numbers, which we collect directly from research respondents for the purpose of recruitment, scheduling, communications, verification, incentives, honoraria fulfillment, and related follow-up.
We also collect certain demographic information, including without limitation age, sex, gender identity, religious beliefs, sexual orientation, race or ethnicity, marital status, parental status, education, and professional credentials, for the purpose of tailoring research opportunities, segmenting panels, targeting samples, and delivering research insights to our clients.
As part of the research process, we may also collect information about consumer attitudes, opinions, political views, party affiliation, purchasing history or preferences, product experiences, and other information related to participant experiences, characteristics, and preferences. Certain studies may also involve medical, health-related, or other sensitive categories of information.
We may collect audio or video of research respondents with their consent. We will only use such audiovisual information for research purposes unless additional consent is obtained for another use.
In the majority of the foregoing instances, respondents will know what information we are collecting because they provide it to us directly. In circumstances where information is sourced from a third-party partner, client, or panel provider, we may receive that information from the third party in connection with the research opportunity, participant management, or study design, subject to the permissions, instructions, or consents applicable to that relationship.
We may also collect certain location information directly from you or from our clients or partners where you have consented to its sharing, including mailing address and ZIP code. We also collect your IP address automatically when you take one of our surveys online. We may use such location information for research purposes, geographic qualification, anti-fraud purposes, or for distributing incentives, honoraria, or products.
We may also use personal information to comply with our legal obligations, update our records, comply with prior opt-out requirements, validate information you provide to us, respond to privacy requests, preserve the integrity of our studies, and otherwise as permitted by this Privacy Policy or authorized by you.
Sharing of Personal Information
We may share your personal information with our clients, subject to appropriate confidentiality restrictions, for the purpose of delivering research results and related services. In many cases, information provided to clients is aggregated, summarized, pseudonymized, or otherwise de-identified. However, depending on the study design, your permissions, and applicable law, identifiable or linkable information may be disclosed in connection with the research services we provide.
We may also share personal information with vendors, service providers, contractors, recruiting or panel partners, shipping providers, and anti-fraud providers as necessary to conduct research, administer studies, fulfill incentives, deliver products, host or process data, communicate with participants, and support our operations, subject to appropriate confidentiality and use restrictions.
We may use or disclose personal information to comply with legal obligations, update our records, comply with opt-out requests, validate information you provide, or as otherwise permitted by this Privacy Policy or authorized by you.
We do not disclose personal information beyond these purposes without participant permission, except in the following circumstances:
- where required or permitted by law, regulation, or court order;
- where disclosure is clearly stated in the survey instrument, study materials, or consent language;
- where necessary to fulfill a participant request made during a study;
- where necessary to protect our rights, property, research participants, or others, including enforcing agreements; or
- in connection with a sale, merger, financing, reorganization, or transfer of all or part of our business.
Where we share personal information with third parties, it is subject to appropriate confidentiality, security, and data-processing obligations.

Your Right to Know, Request Deletion, and Correct
You have the right to know the categories and specific pieces of personal information we have collected about you.

Your Right to Opt Out and to Limit the Use of Sensitive Personal Information
The CCPA defines the term “sell” broadly. Its meaning may include renting, releasing, disclosing, disseminating, making available, or transferring personal information for monetary or other valuable consideration.
This definition may apply when we provide information about you, such as contact information or certain combinations of demographic, research, pseudonymized, or other information, to our clients or other partners as part of the research services for which we are compensated.

Please note that if you exercise your opt-out right, because of the nature of our research business it may not be possible for you to continue serving as a research respondent, panelist, or participant in certain studies.
Personal Information Sold and Disclosed for a Business Purpose
You also have the right to know what categories of personal information we have provided to clients in connection with research results in exchange for a fee or otherwise disclosed for a business purpose, and the categories of third parties to whom that information was provided.
Depending on the project and the preceding 12 months, categories of information that may have been included in research results or otherwise disclosed may include demographic data, such as age, sex, race or ethnicity, parental status, marital status, ZIP code, education, and similar profile information; research responses; research participant photos, video, and audio where applicable; respondent IDs; and other anonymized, pseudonymized, aggregated, or de-identified information derived from research and survey results.
Categories of information we may otherwise disclose for a business or commercial purpose, such as for confidential use by our service providers, may include the above categories, as well as log files, browser type, operating system, device information, IP addresses, mailing addresses, phone numbers, shipping details, and other operational or study-administration information.
Your Right to Non-Discrimination
You have the right not to receive discriminatory treatment by Bovitz for the exercise of the privacy rights conferred by the CCPA, including by denying you services, charging different prices or rates, or providing you with a different level or quality of services, except as permitted by law.
Please understand, however, that we are in the business of conducting research and delivering research results, and certain studies or incentives may depend on the collection, use, sharing, or retention of personal information necessary to administer the study or validate its results.
Your Right to Use an Authorized Agent
You have the right to designate an authorized agent to make a request under the CCPA on your behalf. To designate an authorized agent, please contact us as provided in the “Contact Us” section below. In order to verify that you have authorized an agent, we may require a signed written authorization from you and may also take steps to verify your identity directly.
Information Security
Bovitz is committed to keeping personal information secure and will take reasonable precautions to protect personal information from loss, misuse, unauthorized access, disclosure, or alteration, including reasonable administrative, technical, and organizational measures. These measures may include encryption or similar protections where appropriate, access controls, least-privilege practices, company security policies, vendor oversight, and other measures designed to protect the confidentiality, integrity, and availability of personal information.
Please note, however, that no method of transmission over the Internet, nor any method of electronic storage, is 100% secure.
Information for Individuals in Europe
Our services may be accessed from outside the United States. Personal data collected by us may be stored and processed in the United States or in any other country in which Bovitz or its affiliates, contractors, agents, or service providers maintain facilities.
Individuals in Europe may have the right to request access to, rectification, erasure, or restriction of processing of personal data, to object to processing, to request portability where applicable, and to lodge a complaint with a supervisory authority. Data Retention
We will retain your information, including personal information, for as long as necessary to fulfill the purposes for which we collected it and as permissible by applicable law. You may also participate in research through third-party platforms, partner panels, or mobile applications. Data collection and privacy practices may be different on such sites or applications, and your use of them will be governed by the applicable terms and privacy policies posted there. We strongly recommend that you review such terms and privacy policies for each site or application visited.
Cookies
A cookie is a small amount of data that may be sent to your browser from a web server and stored on your device. As part of offering and providing customizable and personalized services, Bovitz may use cookies and similar technologies to store and sometimes track information about you.
Cookies and similar technologies used by Bovitz may include, without limitation:
- business or operational cookies that function as quality control and verification mechanisms in connection with surveys or research processes;
- performance cookies that help measure and optimize traffic patterns and website usage;
- user cookies that record information to enhance performance and user experience; and
- targeting or measurement cookies used in connection with research, analytics, or market-research-related measurement activities.

Do Not Track
At this time, Bovitz does not respond to browser settings labeled “Do Not Track” except to the extent required by applicable law. Bovitz likewise has no control over third-party websites that may have different policies or procedures. You are urged to consult, as applicable, the privacy policies of such third-party websites.
Research with Children
Bovitz does not knowingly make direct contact with children under 13 years of age to participate in research activities or collect personal information from them without parental consent where required by law.
Certain Bovitz-affiliated panel or study activities may permit participation by individuals age 16 or older, depending on the nature of the panel or study. If a particular study involves minors or otherwise requires parental or guardian consent, Bovitz will implement study-specific procedures appropriate to that project and the laws that apply.
If you are a parent or guardian who has discovered that your child has submitted personal information without your permission or consent where such permission or consent was required, please contact us as provided in the “Contact Us” section below. Bovitz will take reasonable steps to investigate and, where appropriate, remove that information from our records at your request.
Verification Process
If you make a request to access, correct, or delete your information, to opt out of the sale or sharing of your personal information, or to limit the use of your sensitive personal information, we may ask you for additional information to verify your identity or authority to make the request.
This information may include your full name, birth date, phone number, email address, respondent ID, mailing address, or other basic personal information about you that we already have on file.
Notice of Financial Incentive
Bovitz may offer opportunities for you to earn money, rewards, honoraria, sweepstakes entries, products, or other benefits by answering surveys or participating in other forms of research. Participation in these offerings may require you to provide personal information.
Where required by applicable law, we will provide appropriate notice regarding the material terms of any such program, the categories of personal information implicated, and how to opt in to or withdraw from the offering.
Changes in This Privacy Policy

Class Action Waiver
ANY ARBITRATION OR COURT TRIAL, WHETHER BEFORE A JUDGE OR JURY OR PURSUANT TO JUDICIAL REFERENCE, RELATED TO ANY CLAIM UNDER THIS PRIVACY POLICY WILL TAKE PLACE ON AN INDIVIDUAL BASIS, WITHOUT RESORT TO ANY FORM OF CLASS OR REPRESENTATIVE ACTION (“CLASS ACTION WAIVER”). THIS CLASS ACTION WAIVER PRECLUDES ANY PARTY FROM PARTICIPATING IN OR BEING REPRESENTED IN ANY CLASS OR REPRESENTATIVE ACTION REGARDING A CLAIM UNDER THIS PRIVACY POLICY. REGARDLESS OF ANYTHING ELSE HEREIN, THE VALIDITY AND EFFECT OF THIS CLASS ACTION WAIVER MAY BE DETERMINED ONLY BY A COURT AND NOT BY AN ARBITRATOR. THIS CLASS ACTION WAIVER IS VOID WHERE LIMITED OR PROHIBITED BY LAW.
